Prosecutors Oppose Hunter Biden’s Motion to Dismiss Gun Charges

Government prosecutors have rejected an attempt by Hunter Biden’s legal team to dismiss the federal gun charges filed against him. In a court filing on Tuesday, special counsel David Weiss’s prosecutors argued that Biden’s motion lacks evidence to support his claim of selective and vindictive prosecution.

The prosecutors dismissed Biden’s allegations that the charges were brought against him for an “improper political purpose.” They emphasized that the charges were a result of Biden’s own choices and were not influenced by any outside political noise.

The prosecutors pointed to Biden’s own memoir, in which he made “countless incriminating statements” about his drug usage during the period in which he purchased and possessed the gun. They argued that the charges are not baseless and are supported by Biden’s own admissions.

Hunter Biden’s attorneys have not yet responded to the prosecutors’ arguments. The special counsel’s office stated that no further details beyond the publicly filed documents would be provided.

In September, Hunter Biden was indicted on three counts related to his alleged possession of a gun while using narcotics. He pleaded not guilty to the charges.

Prosecutors also revealed that sealed evidence, believed to be in Delaware, was only discovered last year. This evidence consisted of photographs of Biden’s gun, which revealed a white powdery substance later identified as cocaine.

Hunter Biden’s attorneys have previously claimed that their client is a victim of selective and vindictive prosecution. They argue that the probe has been “polluted with politics” since it began during the Trump administration.

Special counsel David Weiss, a Trump appointee, was retained as U.S. attorney for Delaware by Attorney General Merrick Garland due to the sensitive nature of the investigation into a member of the president’s family.

Biden’s attorneys have filed several motions in an attempt to have the gun charges dismissed. They have argued that a previous agreement with prosecutors grants Biden immunity, a claim that prosecutors dispute.

The prosecutors also stated that they have provided over 1.2 million pages of documents and additional electronic evidence from Biden’s Apple iCloud account and laptop, which they intend to use in the case.

In addition to the gun charges, Hunter Biden was indicted in California last month on nine tax-related charges. He pleaded not guilty to those charges as well.

It is important to note that House Republicans have targeted Hunter Biden in their impeachment inquiry into his father. Biden recently defied a congressional subpoena requesting a closed-door deposition, although his attorneys stated that he would comply if issued a new subpoena..
